What are the DUI Laws in Florida?

DUI is defined as operating a vehicle with a blood alcohol concentration (BAC) of 0.08% or higher, or while impaired. A second DUI offense carries more severe consequences, especially within five years of your first conviction.

Potential Consequences of a Second DUI Conviction

Fines

$1,000 to $2,000 typically. If BAC was 0.15% or higher, or a minor was in the vehicle, fines increase to $2,000-$4,000.

Imprisonment

Mandatory minimum of 10 days in jail if within five years of first DUI. Up to nine months in jail or 12 months if BAC is 0.15% or higher.

Probation

Up to one year of probation with regular reporting, abstaining from alcohol, and random testing.

Community Service

At least 30 hours of community service.

Driver's License Suspension

If within five years of first, license revoked for minimum five years. Hardship license possible after one year.

Vehicle Impoundment

Vehicle impounded or immobilized for 30 days.

Ignition Interlock Device

Required for at least one year. You pay installation and maintenance.

DUI School and Substance Abuse Counseling

Mandatory DUI school and substance abuse evaluation.
